Connect MyTown Inc is a platform that connects people so that services can be provided and received in an efficient way using online booking tools and payment. Some services categories include home, personal, repair, activity planning, and instruction/tutorials. 

 

By using Connect MyTown Inc you are agreeing to the terms and conditions laid out below. This applies to the Connect MyTown website as well as any Connect MyTown apps on smart devices and tablets. If you do not agree with these terms and conditions, you may not use the platform.

 

The services provided via Connect MyTown are available for personal, non-commercial use only.

 

Once a service is requested and accepted by two parties, they enter into a mutual contract that is subject to Connect MyTown terms and conditions as well as any relevant provincial and federal laws.

  1. Updates

Connect MyTown may make updates to these terms and conditions. All service providers and service users will be made aware of changes taking effect.

 

  1. Eligibility

Any Canadian citizen over the age of 13 is able to have a Connect MyTown account. This is based on the minimum age of 13 to have a ‘Stripe’ account. However, to list a service, service providers must meet the minimum age to work in their province, as indicated by provincial laws.

 

To have a Connect MyTown account, service providers and service users must have a valid email address. Connect MyTown does not conduct criminal/background screening checks on service providers and service users.

Connect MyTown uses the platform ‘Stripe’ to transfer funds online, therefore in order to list a service, service providers must sign up for a ‘Stripe’ account and will be subject to their terms and conditions. Service users must have a valid credit card in order to purchase services through ‘Stripe.’ 

 

  1. Privacy Policy

All information collected by ‘Stripe’ from service providers and service users will be subject to ‘Stripe’ privacy policies. Connect MyTown will not store the financial information of service providers or users. 

 

Connect MyTown may provide necessary information to authorities or an insurer if there is a conflict or complaint involving the service provider or service user.

 

Connect MyTown will ask you for permission to use your smart phone camera. This is for your profile photo and/or photos related to the service you are listing. If you do not enable the camera, you can still upload an existing photo from your smart phone or your computer. For personal security, a member’s profile photo will not be visible to other Connect MyTown service providers or service users until after a service is booked. Once a service is booked, the profile photo of the service provider and of the service user will be visible to each other.

 

Phone numbers and email addresses shall not be included on a member’s profile or in initial message exchanges between service providers and service users.

 

When a member is signing up for an account, Connect MyTown will ask for an address. This information is only required if you are listing a service that you will provide in-person or if you will be searching for in-person services by distance. The app allows you to connect with users based on distance.

 

  1. Service Provider Conditions

Service providers are those who have a service listed on the Connect MyTown website or app. The individual providing the service must hold the account with the listing. Each listing (one service per listing) will be subject to review by Connect MyTown. Listings must be viewing appropriate for all ages and must align with the company’s purpose and the herein terms and conditions (note that the company’s purpose can be found in the “About” section of the website/app). Connect MyTown has the right to delete accounts or listings when deemed to be inappropriate.

 

Service Providers are expected to include a photo of themselves in their profile and shall ensure that all information on the listing is accurate and up to date.

 

Services can be delivered in person or virtually. When the service provider lists their service, they will have to select “in-person,” “virtual,” or “either.” If the service provider indicates “either,” it will then be the service user’s choice for delivery method. When booking, the service user must confirm their preference. If the service provider is offering “in-person” they should indicate on their listing whether they will travel to the service user or would like to service user to travel to them. Exact addresses and/or phone numbers can be able to be exchanged via chat once the booking has been confirmed.

 

Each service must be listed for a minimum of $10 per hour or $10 per service.

 

The service identified in the listing will not be physically validated, trialed, or guaranteed by Connect MyTown. If the booked service was not provided to the service user during the time booked, the service user may contact Connect MyTown and as a result, the service provider may not receive payment, and the service user may receive a refund. In this scenario, the service provider may also have their listing (or account) removed.

 

For an in-person service, it is the responsibility of the person travelling to arrive for the appointment on time.

 

If the service provider is travelling to the user’s residence, they agree to leave service user’s location once scheduled appointment is complete.

 

The service provider is liable for all activities using their account and should therefore ensure that they are the sole user and keep their username and password private. If the account has been accessed without permission, Connect MyTown should be contacted immediately in order to ensure other service providers and service users have not been impacted and the account is deleted immediately. 

 

Service providers agree to ensure that all terms indicated in their listing abide by these terms and conditions as well as any applicable provincial and federal policies.

 

Service providers have the right to decline a booking request and are not required to provide a reason. However, if the service is listed as available during the requested slot, this is not a recommended practice.

 

If a service provider cancels their account, bookings will be automatically cancelled and funds will be returned to the service user.

 

Connect MyTown recommends that service providers have insurance to protect property as deemed necessary. Connect MyTown does not provide coverage.

 

When accessing the app through Apple, Google for Android, or Microsoft for any access to Connect MyTown, you agree to the respective user agreements

  1. Service User Conditions

Service users are those who have purchased (or are in the process of purchasing) a service from a service provider through Connect MyTown Inc.

 

Service users are expected to include a photo of themselves in their profile and shall ensure that their account information is accurate and up to date.

 

If the service provider has opted for “either” for the service delivery option, the service user will have to select their preference of in-person or virtual when booking. Exact addresses and/or phone numbers can be able to be exchanged via chat once the booking has been confirmed.

 

The service identified in the listing will not be physically validated, trialed, or guaranteed by Connect MyTown. If the booked service was not provided to the service user, the service user may contact Connect MyTown and as a result, the service provider may not receive payment and listing may be removed. After the end of the scheduled appointment, the service user will have up to four hours to contact Connect MyTown to request a refund – this is to give Connect MyTown time to process a potential refund before payment is processed.

 

For an in-person service, it is the responsibility of the person travelling to arrive for the appointment on time.

 

If the service user is traveling to the providers residence, they agree to leave service provider’s locations once the scheduled appointment is complete.

 

A guardian may book a service from their account on behalf of a minor (a parent booking a tutorial for a child for example). However, it is the guardian’s responsibility to indicate to the service provider that the user will be a minor. When the service provider writes the review of the user (the child in this example), the communication and review will be through the profile of the account holder (the guardian in this example). The review and score will be based on the criterion set out in the Reviews section of these terms.

 

The service user is liable for all activities using their account and should therefore ensure that they are the sole user and keep their username and password private. If the account has been accessed without permission, Connect MyTown should be contacted immediately in order to ensure other service providers and service users have not been impacted and the account is deleted immediately. 

 

If a service user cancels their account with more than 12 hours before the appointment, payment will be returned (minus the Stripe transaction fee that was already charged). If a service user cancels their account inside of 12 hours, only a partial refund will be possible.

 

Connect MyTown does not provide any insurance for whatever reason for the benefit of service providers and service users.

 

When accessing the app through Apple, Google for Android, or Microsoft for any access to Connect MyTown, you agree to the respective user agreements.

  1. Gift Card

Connect MyTown service providers and service users are able to purchase gift cards for others for future use. The gift card will not expire unless the platform closes down. To purchase a gift card for someone, you will require an email address for the recipient/giftee. The giftee will receive an email notification and will be required to set up a Connect MyTown account to claim the gift. The gift card can be used as a credit towards any service on Connect MyTown. The gift card amount can be any amount of your choosing at a minimum amount of $20.

 

It is not currently possible to use a Connect MyTown gift card to cover the required transaction fee of a purchase, due to limitations with Stripe. Therefore, when the giftee uses their gift card, they must pay the transaction fee separately. The ‘Stripe’ transaction fee is currently 2.9% + $0.30 and will need to paid via credit card. For example, a $20 value at checkout would require $0.88 and a $40 value at checkout would require $1.46 and so on. If the gift recipient chooses a service that will cost more than the value of the gift card, the additional cost plus the ‘Stripe’ transaction fee can be paid by one credit card transaction.

 

  1. Booking Fees and Taxes

Creating a profile and listing a service is free.

 

Once a booking is confirmed, the service user will be required to pay the listing price plus a 13% service fee. 

 

The service provider will collect the listing price minus a 5% service fee.

 

Service fees cover the cost of managing and maintaining the Connect MyTown platform.

 

Payment is due by the service user immediately upon accepted booking request. Funds will be held in abeyance until after the service is completed. Connect MyTown will facilitate payment using Stripe and both service providers and service users will receive a receipt for goods/services provided/received.

 

Service fees are subject to change but notice will be provided at least 14 days in advance. Any bookings made before this date will not be impacted.

 

Payment for services received through the Connect MyTown platform must be paid for through the Connect MyTown website and/or app. 

 

  1. Changes and Cancellations

Service Providers and Service Users are able to change or cancel the service up to 12 hours before the appointment without penalty (with the exception of the Stripe transaction fee that was charged to the user on initial booking). Service providers must cancel by contacting Connect MyTown or by requesting the user cancel the booking.

 

If a service provider does not show up for the Connect MyTown scheduled time, the service user should contact MyTown to request a refund. After the end of the scheduled appointment, the service user will have up to four hours to contact Connect MyTown to request a refund. This will give Connect MyTown time to process a potential refund before payment is processed.

 

If a service user does not show for the MyTown scheduled time, the charges will continue to be processed.

 

Services by the hour: There may be scenarios where a service user would like to book the service provider for a longer period of time than scheduled. A good example of this would be an individual scheduled to paint a house by the hour. The service may take more time than was previously booked. In this instance, the service provider can request additional funds (based on the price of the listing) and the service user will have to accept. If more time is needed but the service provider has another appointment following or is unavailable, the service user can request another booking/time.

 

  1. Reviews

Reviews are important for Connect MyTown service providers and service users. Service providers will be rated on:

 

  • Accuracy of listing
  • Quality of product/service
  • Value 
  • Communication 
  • Punctuality

 

Service Users will be rated on:

  • Preparedness
  • Communication 
  • Punctuality

 

Reviews must be kept professional and must be based on the criterion provided. Connect MyTown has the right to remove any comments it deems to be inappropriate or unrelated to the service provided/received.

 

If reviews have discrepancies, Connect MyTown may be contacted for potential resolution. Note that review scores are confidential and will not be shared. The average score (overall) and the comments will be public.

 

  1. Disclaimers

Service providers and service users are responsible for all content that is posted in Connect MyTown, including profiles, listings, and messages. By agreeing to these terms and conditions, you warrant that you are the owner of all content provided and have the rights to provide this information and does not infringe on proprietary or intellectual property or privacy rights or result in the violation of any applicable laws or regulations. You agree that you will not post, publish, or share any content that is false, misleading, vulgar, offensive, discriminatory, defamatory, harassing against a member or group.

 

Connect MyTown has the right to reject any listing or profile that it feels is inappropriate or does not represent the company’s purpose or values.

 

Connect MyTown Inc does not provide warranty on services. Service providers and service users provide and use the services at their own risk. Service providers and service users are responsible for reviewing and understanding Connect MyTown policies when initiating their account and using the platform.

 

Connect MyTown is not responsible for any illegal matters between service providers and service users.

 

Connect MyTown is not responsible for any Internet disruptions that may arise due to connectivity, site maintenance, or updates, while using the platform.

 

Connect MyTown service providers and service users or browsers cannot remove any proprietary information from the website or app such as company name, logos, service names/marks

 

Connect MyTown service providers and service users or browsers cannot use the Connect MyTown platforms to gain additional access to collect information on the company or any of its service users or service providers.

 

  1. Limitation on Liability

In no event will connect MyTown Inc be liable to any service user or service provider, its subcontractors, or their respective personnel under or in relation to this agreement under any legal or equitable theory, including breach of contract, tort (including negligence), strict liability or otherwise, for any consequential, incidental, indirect, exemplary, special, enhanced or punitive damages, regardless of whether such person or entity were advised of the possibility of such damages were otherwise foreseeable, and notwithstanding the failure of any agreed or other remedy of its essential purpose.

 

  1. Indemnifications

Service users and service providers agree to defend, indemnify and hold harmless Connect MyTown Inc. and its Affiliates, and all of their respective stockholders, members, managers, officers, directors, employees, licensees, agents, and the Approved Service Users and Service Providers (collectively the “Indemnities”) of, from, and against any and all third party claims, demands, actions, causes of action, losses, liabilities, damages, including without limitation, reasonable attorney’s fees (collectively referred to as “Damages”), based upon or arising out of a) any act, omission, negligence, or misconduct of the Service User and Service Provider; Service User’s and Service Provider’s agents; b) any breach of the terms of this Agreement; c) infringement of a Canadian or international copyright, trade secret, intellectual property, patent or proprietary right; or d) violation of applicable laws I connection with the use of Connect MyTown and its third parties. Such indemnification shall not be relieved by any insurance carried by Connect MyTown.
